Terms of service

CushyCal is operated by Everburn Studio Ltd, a company registered in England and Wales (company number 17511259), registered office 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ (“we”, “us”). These terms apply when you create an account to take bookings (a “host”). People who book time with a host (“clients”) only need to read our privacy policy.

1. Your account

  • You must be at least 18 and able to enter a contract. Keep your sign-in email secure — anyone with access to it can sign in.
  • You're responsible for what happens under your account and for the accuracy of what your booking pages say.

2. Plans, trials and billing

  • The Free plan is free for as long as we offer it. On Free and Lifetime, a platform fee shown on our pricing page is deducted from payments your clients make through CushyCal. We'll give you at least 30 days' notice before changing the fee on your plan.
  • New accounts get a 14-day Pro trial with no card. At the end you move to Free automatically unless you choose a paid plan.
  • Paid plans renew automatically each month or year until you cancel. Cancelling stops the next renewal; you keep Pro until the end of the period you paid for, then move to Lifetime if you bought it, or Free. We don't refund partial periods, except where the law requires it.
  • If a renewal fails we retry the card and keep Pro for up to 14 days, then move the account to Free. Nothing is deleted.
  • The Lifetime plan is a one-off payment for the Lifetime plan's features, including features we add to that plan later, for as long as we operate CushyCal. It doesn't include Pro-only features such as included text credits or the API. The price shown when you buy is the price you pay; an early price may apply to the first buyers. It isn't transferable.
  • Prices exclude taxes, which are added at checkout where they apply. We'll give at least 30 days' notice of a price change for an existing subscription; you can cancel before it applies.
  • Prices, offers (such as early Lifetime prices) and trial lengths for new purchases may change at any time; the pricing page shows the current ones. A change never affects a Lifetime plan or Lifetime seats you've already bought.
  • Payments to us are processed by Stripe.

Teams

  • A team's plan is paid by the team (the owner or an admin who buys it), not by each member. Members get the team's features for team bookings while they're in the team; their own account keeps its own plan.
  • Lifetime seats are a one-off payment per member (£149.00 each at the moment). When someone leaves, their seat is free for someone else. Seats aren't refundable once bought, except where the law requires it, and can't be moved to another team.
  • Team Pro is billed per member each month or year (£10.00 per member a month at the moment). Adding or removing members changes the bill, with a pro-rata charge or credit for the rest of the period.

Fair use

Plans are for normal use by the people they're sold to. Where something costs us money each time it's used (such as text messages, which are sold as credits), plans include the amounts shown on the pricing page. If an account's use is far beyond normal use of its plan, we'll contact you first and agree a fair way forward before limiting anything.

3. Taking payments from your clients

When your clients pay you through CushyCal, the payment goes to your own Stripe account. You are the seller: you set your prices, refund policy and no-show fees, and you handle refunds, chargebacks and disputes with your clients. Stripe's terms apply to your Stripe account. We are not a party to the contract between you and your clients.

4. Your clients' data

You decide what you collect from clients (for example the questions on your booking form). For that information you are the controller and we process it for you under our data processing terms, which form part of these terms. Only ask for what you need, and tell your clients how you use it.

5. Acceptable use

  • No spam: don't use reminders, texts or emails to contact people who haven't booked with you.
  • Nothing illegal, deceptive or harmful, no impersonation, and no attempts to break, overload or get around the limits of the service.
  • We may limit messages, pause bookings or suspend accounts that put clients, other hosts or the service at risk. Where we can, we'll tell you first and explain why.

6. Connected calendars and other services

If you connect Google Calendar or Outlook, we read your busy times and write the bookings you receive, as described in our privacy policy. You can disconnect at any time. Third-party services have their own terms, and we're not responsible for their outages.

7. Availability and changes

We work hard to keep CushyCal running and your data safe, with daily backups, but we can't promise it will never be interrupted. We may change or retire features, and move features between plans. If a change materially reduces what you're paying for, we'll tell you at least 30 days in advance and you may cancel and get a pro-rata refund for the rest of the period you paid for. We won't remove a feature from the Lifetime plan that it included when you bought it, unless we can no longer offer it to anyone (for example because a third party ends the service it depends on).

8. Ending your account

You can export your data and delete your account at any time from Settings. We may end these terms with 30 days' notice, or straight away for serious or repeated breaches. Sections 3, 4, 9 and 10 survive the end of these terms.

9. Liability

CushyCal is provided “as is”. To the extent the law allows, we're not liable for indirect or consequential losses (such as lost profits or missed appointments), and our total liability in any 12 months is limited to the greater of what you paid us in that period and £100. Nothing here limits liability that can't be limited by law, or your rights as a consumer.

10. General

We may update these terms; we'll email you about material changes at least 14 days before they apply. These terms are governed by the laws of England and Wales, and its courts have jurisdiction. Questions: support@cushycal.com.
